Alan Keyes, Presidential candidate of the American Independent Party, Wiley S. Drake, V.P. candidate of the Independent Party and California elector, and Markham Robinson, California elector, filed suit in California on Nov. 12, 2008 against Barack Hussein Obama and others.
The Plaintiffs are seeking a Court Order barring the California Secretary of State from certifying the California electors until documentary proof that Senator Obama is a “natural born” citizen is received by the Secretary. Their complaint states in part:
There is a reasonable and common expectation by the voters that to qualify for the ballot, the individuals running for office must meet minimum qualifications…., and that compliance with those qualifications has been confirmed by the officials overseeing the election process. Heretofore, only a signed statement from the candidate….was requested and received by SOS, with no verification demanded.This practice represents a much lower standard than that demanded of one when requesting a California driver’s license…
Plaintiffs go on to argue:
…If he was born in Hawaii, there are four other obstacles to Senator Obama’s eligibility….
They apparently first contacted the California Secretary of State about their concerns on October 25.

I am cautiously excited. There is the Berg case, the martin case, Donofrio, possilby a couple othes, and now this one. A few others have been thrown out, mainly for the same reason…standing. Keyes definitely has standing, and can prove personal harm.
I am worried as usual though. Will the courts, or the supreme court, stand up for what is right and uphold the constitution? or, will they bow to fear and political correctness, in fear of being called racists? Will they fear riots? If anything happens, it is all Obama’s fault, so they should not worry.
If we elect an ineligilbe president, the results would be far more catastrophic….treaties would be invalid, nations would not trust us, it would be far worse.

Obama’s grandmother, Sarah Obama, has claimed she was in the hospital with him when Obama was born in Africa. Then he had to have citizenship in Indonesia to go to the muslim school there. I’ve been listening to some radio lately, and seems like some folks are starting to put more effort in “hard-core” facts that might bring him down. Some folks believe the reason he hasn’t released the bc is because he wants everyone to continue to focus on that instead of the “real issues” that could cost him the Presidency, such as his “Logan Act” issues and now the fraudulent Selective Service form.
I think we should attack him from every angle humanly possible, and not focus [all] of our attention on something that seems to be of no concern to the courts.
The Logan Act is definitely something that could alter the final votes cast by Electors. I read the Alan Keyes lawsuit and it sounds better than Phil Bergs. It is well written and logical. I think that they picked California because of the past cases with Eldridge Cleaver etc. where California did document with a birth certificate that he wasn’t old enough to run for president. He was thrown off the ballot because of this. So there is precedent for doing so now.
It also clearly lays out that it is not settled that Barak Obama is a natural born citizen. That there is in fact doubt about his citizenship and place of birth. It brings up a Kenyan grandmother who claims to have been at his birth in Kenya. It brings up the fact that two hospitals have been named as his hospital of birth. It brings up the Catholic school record that states that Obama was an Indonesian citizen while pointing out that if he became Indonesian that the Indonesian government did not allow duel citizenship so he would have had to give up his U.S. citizenship.
And of course, Alan Keyes, his Vice Presidential running mate and one of their California electors who have filed this lawsuit all have standing to bring this because they can prove that they have been damaged by having an unqualified candidate on the ballot.
Do we dare to hope? Right on John Mirse and Socalannie. I’d like to introduce Jennifer Boucher to my brother in Fairfield. They have so much in common. I promise I won’t use the F word even once and I am one of those who skimmed right over that once I saw how idiotic it was.
I had to show my birth certificate (certified copy), adoption certificate and marriage certificate all just to prove who I am to NJ to get my drivers license renewed in January 08! (they needed to see proof of all the name changes).
I did not hire 3 teams of lawyers to fight it, I just got the papers and showed them. How easy and cheap it would be for Obama to simply show a certified copy of his BC like McCain did this year when his birthplace was questioned.
Hawaiian law in 1961 allowed creation of a Hawaiian birth certificate even if child born out of country, but the certificate must show actual doctor and hospital’s names. So let’s see it. Obama. If you have nothing to hide, show the judge. Pick a judge, any judge. You have 17 to choose from. Pick one and show it. Or just let Hillary take your place, you know that’s going to happen anyway.
My theory, Obama made a deal with the Clintons that if and when this all came to light, Clinton would take his place if Obama wouldn’t go to jail (that’s the punishment by law of anyone who usurps the presidency, usurping is what this would be called according to the Constitution).

John Mirse, the hospital cannot release patient information to the public. That would be a violation of HIPAA laws and there is no reason for the hospital to do this. It’s also unnecessary because Obama could save a lot of trouble and money and proudly produce his original vault version.
The question is not to the hospital, but to Obama or to the courts. Putting my faith in either one of them is a long stretch. What is most curious is Obama’s reluctance to address the issue he knows is out there.

As for the Keye “4 additional points” – they’re wrong, too.
1. The US recognizes dual citizenship – it doesn’t matter if Indonesia doesn’t. One can only lose one’s citizenship by consciously repudiating it. The US has NO way for someone to loose their citizenship OTHER than by deliberately choosing NOT to be a citizen. Also the (I think) 14th Amendment says that children’s citizenship cannot be revoked because of the actions of the parents (adoption etc).
2. Since Obama never lost his citizenship, there would be no need for him to ‘get it back’.
3. Even IF Obama was born in Kenya (and there is no proof he was), Kenya allows dual citizenship until the age of 18 – at which time, one must swear allegiance solely to Kenya or LOSE that citizenship automatically. Of course, one would first have to PROVE that he was born in Kenya.
4. There was no ‘ban’ on Pakistan travel when BO travelled there. It was difficult, but not prohibited. And travelling with a foreign passport does not (legally) meet any standard for losing one’s citizenship.
Keyes may have standing, but he doesn’t have a case.

It appears this problem is not going to go away for Mr. Obama until the vaulted certificate is produced. I suspect, however, that he hopes to get in office first, then challenge this “natural born” provision using the 14th Amendment. I think that has been his plan all along.
After he is in office he would make the argument that all citizens are simply citizens and that the provision requiring one be a natural born citizen discriminates against naturalized citizens and violates the 14th Amendment.

This is in his argument for the Electorial College. And now we have an Elector in California challenging Obama with this lawsuit. See how the Constitution works?
The problem is that if Obama’s electors are disqualified, they would not go to Keyes. So, he may not be deemed to have standing either. Plus, since electors are chosen as free agents who can cast their ballots for anyone, the fact that the person who they pledged to vote for as president is not eligible would not automatically disqualify the elector who has duly been selected by the voters.
I have felt that the time that action at the state level could have succeded was prior to the election in an effort to keep Obama off the ballot.
Now, the only thing I see that can work is for someone with standing to have the Supreme Court de-certify his election, or to have Congress fail to certify him. The chances of either of those happining is .000000000001 %. But, the real goal is to force the release of the vault copy of the birth certificate to see what Obama is hiding.

I’m afraid I don’t find your arguments convincing. If McCain couldn’t fix the mess we’re in, I have trouble believing Obama could, for similar reasons. The fact is, they’re both politicians and have both led lives that have been, for the most part, privileged. They may have somewhat different political ideologies, but if it’s been proven that Republicans can really mess things up, the same has been proven of Democrats as well. The best policy, in my opinion, is to make sure there’s a limit to the things politicians can mess up. Unfortunately, our country seems to be heading in exactly the opposite direction.

Your comment makes no sense. If Obama is indeed eligible to be president, then a few court cases won’t prevent him from taking office in January and exposing “some of the more heinous crimes of the Bush Administration”, if that’s what he intends to do. Indeed, there’s plenty Obama can do to help speed up the process of qualifying himself to take office in January, if that’s what he really wants to do. I’m all for transparency and honesty in my elected officials.
Also, while I can’t speak for any of the other commenters here, many of whom are Democrats or former Democrats, I can say that my own conscience is perfectly clear with respect to the extent that I have defended our sitting president, and to the extent that I have criticized his actions over the past eight years. Should Obama take office and serve a term or two, I hope I can say the same. But there are a few things Obama can do to start his term off on the right foot….

Obama has Gainned more hate than any President Elect, Why?
I will agree I want the Communist out of office before he can do the damage he has planned, but the cries for his death, are way out of line. The racial comments, and white supremacist, and other nit jobs need removed. My point is to remove Obama legally, and properly, as there has been to much action on the Democratic side, that violates all legalities of any election.
There was for one, the fact Obama has quit every Community operation and took credit for those that someone else completed. His Community Organization was all fabricated, and the man has never finished anything he ever started. This makes him a fraud, but the Democrats promoted him as something facts could not support.
Second, Obama was raised pro-Communist, which is not a valid view for any President of the US. This does not mean they have to think the way I do, or anyone else, but they need to at least believe in a Democratic Republic as this Country was founded on.
Third, there has never been legitimate proof that Obama still has his Citizenship, and is still in question now. It is only that the Democrats pushed through this, without offering legal proof to prove it. It is a known fact to go to school in Indonesia, at the time Obama did, he had to be a Citizen of that country. There was no dual citizenships there at that time. And there is no proof that he ever got his Citizenship when he returned to the states.
Fourth, Obama is with the DSA, not the DNC, which joined with the CPUSA in 2000 to push a member between the two to President. What this means is that Obama is not a Democrat, even though the DSA is a wing of the DNC, and the CPUSA is a member of the DNC, they are not the DNC. What this does mean, is that he is part of a move to convert the USA into another form of Government, and the DNC knew this, and refused to inform their members of what was going on.
The Liberal members of the DNC have a long history of refusing to questioning information they are given. So this makes it easy for the DNC, DSA, and CPUSA to use these people without their knowledge.
In 2000, at the Chicago Women’s Conference, sponsored by the CPUSA, has a specific historical significance. Besides the Woman’s Conference, heads of the CPUSA, DSA, and Greens Party all met with an offer to join forces to push a presidential candidate into Office. In 2004 the lost with the Kerry Ticket, but learned how to work more effectively together. In 2008 they push a little known failure of a Senator, Obama, into the front running. They now have their puppet for President.

I found your article very interesting – I knew about the birth certificate issue (different borders) but not about the other things mentioned in the lawsuit. I am especially concerned as my husband is in the military and Obama would be his commander in chief. I hope something comes of this – and it isn’t bogged down in court for the next 4 years. Have they sought out other legal documents where he would have to declare his citizenship (ie. his children’s birth certificates, marriage certificate)? Also, what about the Indonesian govt. and the muslim school – do they have his records? As for the Kenyan hospital – couldn’t someone request records from there – or does HIPPA apply there too?

The Republican Governor of Hawaii may have done a huge favor in sealing the birth certificate. First, it might have protected it from tampering and second, it may have preserved legitimate discovery rules precluding any future dismissal if it was circumvented.
The three non-American citizenships are as much of merit as the birth certificate because the intent of the Constitution in preventing naturalized citizens from becoming POTUS is to avoid divided allegiances…Well 0bama has a most egregious case of divided allegiances with three known citizenships other than American.
British, Kenyan, and Indonesian ALL by his own admission (the first two on his website the last in his book where he admits traveling on an Indonesian passport in 1981–no other way to get one of those other than being a citizen of Indonesia).
This is the last staging of resistance against Unconstitutional Nobama; divided allegiances.
Uh-oh, they meet again. President-elect Barack Obama and Ambassador Dr. Keyes were pitted against each other once before, during the US Senate race in Illinois in 2004, where Mr. Obama trounced Dr. Keyes, garnering over 70% of the vote. Wonder what the outcome of this re-match will produce?

The HOUSE doesn’t just CHOOSE a president if Obama is deemed ineligible.
If Obama, the winner of the general election, is shown to be ineligible BEFORE the meeting of the electors (Dec. 15) it is likely that the electors would naturally turn and vote for McCain. However, they may vote for ANY PERSON ELIGIBLE to be President.
The House would only vote if electors fail to give 270 votes to a single candidate…and they may ONLY choose from the top three electoral vote getters (e.g., they can’t just vote Pelosi in as President). According to the electoral college procedural guide, the process goes as follows:
The electors meet in each State on the first Monday after the second Wednesday in December (December 15, 2008). A majority of 270 electoral votes is required to elect the President and Vice President. No Constitutional provision or Federal law requires electors to vote in accordance with the popular vote in their State.
If no presidential candidate wins a majority of electoral votes, the 12th Amendment to the Constitution provides for the presidential election to be decided by the House of Representatives. The HOUSE would select the PRESIDENT by majority vote, choosing from the THREE CANDIDATES WHO RECEIVED THE GREATEST NUMBER OF ELECTORAL VOTES. The vote would be taken by State, with each STATE DELEGATION having ONE vote.
Now, if Obama is found to be ineligible AFTER he becomes President-Elect then the V.P. would temporarily serve as President until a qualified President can be chosen.
According to the 20th Amendment, Section 3:
If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have FAILED TO QUALIFY, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.
At this point, I presume, either the electors would be allowed to reconvene and actually vote for a qualified candidate, and the process would proceed per the normal electoral procedural guide, or the House would instead choose from the remaining TWO candidates who received the greatest number of electoral votes in the initial Dec. 15 vote. In order to have TWO remaining candidates to choose from instead of just one (McCain) would result only if at least one elector goes rogue; voting for someone other than their state’s popular vote candidate. This is the only possibile way for someone other than McCain to become President…that is unless McCain is found to be ineleigible too!
The Constitution trumps any law enacted by Congress, including HIPAA.
I read a comment on some other blog (sorry that I don’t remember which one) that was written by an Indonesian. He provided all Indonesian laws pertaining to Dunham’s marriage to Soetoro and BO’s subsequent Indonesian citizenship. He translated the laws into English. He also translated the text of the school registration. He stated unequivocally that Obama WAS an Indonesian citizen when he attended school in Indonesia. Furthermore, he said that in order to live in Indonesia, BO had to have given up his US citizenship, as did his mother, who would not have been recognized as Lolo’s wife otherwise.
So, unless BO was re-naturalized, even now he may not be a legal citizen of the US. Note that Berg is also requesting copies of naturalization papers, if they exist.
What concerns me is that apparently a US government agency has presented to a citizen, in response to an FOIA request, what looks like bogus documents. If I were the person who received those “selective service” documents, then I would send copies to my representatives in Congress as well as to the FBI, asking for an investigation. This is an outrage, to say the least.
IF at this point BO does produce any of the documents requested by these suits, can anyone believe that ANY of them are legitimate?

If there is something suspicious on Obama’s vault birth certificate…I think the Governor of Hawaii should report it to the FBI, CIA, Homeland Security and all other appropriate Government agencies. That way their rear end would be covered and the Governor of Hawaii wouldn’t be an accessory.

Is MSNBC being rewarded for having supported Obama? That’s what Jim Pinkerton suggests. On this evening’s Fox News Watch, the columnist and New America Foundation fellow cited the news that GE Capital, a subsidiary of MSNBC’s parent company GE, has received a $139 billion government loan guarantee.
This evening’s show opened with a clip of Chris Matthews [in a story that NB was first to report], saying that he saw as his “job” making the Obama presidency a success. Pinkerton unloaded.
But I think that the overall culture of MSNBC was established when they changed their slogan, post-election, to “The Power of Change” [another story NB was first to report]. Now, that sounds a little bit familiar to the Obama campaign “Change We Can Believe In.” Maybe that’s not an accident.
But of course, I think the big story here, I think it goes right to what MSNBC’s up to as a strategy, is the news that the FDIC, which is now following election returns, is guaranteeing $139 billion of General Electric Capital debt. That’s General Electric Capital, as in General Electric, which is the parent company of MSNBC, CNBC, NBC. Now, for a $139 billion guarantee, I’d consider, I’d probably go more, I’d probably go all the way over to the Olbermann/Maddow territory. $139 billion.

I live in Georgia, and we have a run-off election coming up between Jim Martin (D) and Saxby Chambliss (R). Barack Obama is helping to fund Jim Martin’s campaign. They came out with a despicable ad about Saxby today.
BO is trying to make Saxby’s seat a democratic one, so he can push his radical agenda.
My question is this…..Where is BO getting all this money for all of this stuff?

2. There is also a Hawaii address listed in a 1961 Obama birth announcement in a Hawaii newspaper that someone supposedly recently found by accident while doing research on the web on Obama.
3. The addresses don’t match.
4. NOTE: I don’t live in Hawaii, but as I understand it, the address listed in the 1961 newspaper announcement is in a very upscale Hawaii neighborhood.
5. My point is this: I don’t think a young foreign college student and his new very young bride would have been able to afford to live in that Hawaii neighborhood in 1961.

Great post, ive been following several of these cases hoping at least one of them would bring some resolution, and I think Keyes may have the best shot. As a point of clarification, there is no chance of McCain becoming president if Obama is indeed found ineligible. Should it happen before the electors vote, then Biden or would be voted in instead, should it happen after Biden would by default become president.
In regards to Jennifer’s comments. My gasoline is now $2.10. Are you going to tell me that is because Obama is in office? How about the bailout…Obama supported that too! Oh and the economic crisis? We can thank Fannie mae and Freddie Mac for that…and whose presidential campaign were their board members top advisors for? Right Obama’s. High grocery prices? thats mostly because ethanol production has caused corn prices to skyrocket leading to famines in some countries, and higher grain, milk, corn, bread, and meat prices in ours. Ethanol production pollutes more than cars driving without ethanol, and it takes more than one barrel of oil to produce one barrel of ethanol. Higher food prices, bad economy, high gas prices are not thanks to bush, they are thanks to socialist programs and foreign competition. Gas prices went up because demand went up, demand went up because more countries are modernizing.

About the hospital privacy act:
They can’t release information about a real patient, but they can truthfully deny having information about a patient they never had, thus no one’s privacy is invaded. The patient never was, he/she had no privacy to protect. If they do have information they would refuse to release it, but they couldn’t truthfully deny having it. In my opinion, all denials are subject to suspicion with this guy.
About the SSS registration:
I thought it was interesting that most of O’s writing had a firm, even baseline which stayed in the same relative position to the form line, except for two words: Obama and underneath it, the street name. It’s like writing over a hump, or something, doesn’t fit with the rest. There are many other funny things about it, but I have seen some very funky real documents. Someone like Polarik or the FBI would be better able to pin down any falsities.

What you don’t understand there is a constitution and amendments to that constitution. Thousands of men and women over the last 200 years have fought and died to maintain the freedoms associated with said document. In the constitution it states the president of the United States must be a naturalized citizen. I have to believe he was not vetted because in order to run for other offices you don’t have to be naturalized. IF in fact it is found that he is not naturalized (and obama knows one way or the other), it proves that he is simply subverting our constitution, our country and for what it stands for. He has no respect for our country.
As this continues I remember the book written by ayers. one of the things in the book is that the United States will/should be destroyed from within. The people of the United States should be assimilated (marxist socialist doctrine) and those that will not assimilate be taken the ’assimilation camps’ (getting scary here?) and then if there are those that resist further, they will simply be eliminated. This is a man that calls obama a friend.
The pieces are all there, they just haven’t been put together. All of this might have been sorted out if the media didn’t have such a love affair with him. actually that question has been gone over, but you would have to hunt through past threads on the BC, the theories aren’t available in a compact pile.
I believe that it was done early, maybe even back in 1961 when he was born. He could have gotten a passport with his mother (family passport). He could have used a late Hawaii registration to get his own. Who would question an infant if the family concocted a cohesive story? Having once gotten one, he just keeps it up over the years. The passport office doesn’t know about Kenya or Indonesia, for whatever reason, and just assumes he deserves it. They are good for 10 years, long enough for the whole roundtrip back to the US, and by then it would be obvious to the family that it would be good to keep. The same with the passports of other countries.
To rationally discuss this, we would need to know more about passport policies and how the agency works.
When I first got one, which was 1968 or so, it seems that I was able to prove my birthplace with a baptismal certificate. I may be misremembering and thinking about a driver’s license, but it seems like it was easy.

Odd, the closer the election got, the more fear I saw in McCains eye. I believe in my heart that he knows the truth, and tried to tell us all without coming right out and saying it. Same for Palin. After all McCain knows truth and he has stood for America his whole life.
I can only hope and pray that the courts remove Obama and somehow McCain wins by default. biden should not be allowed anything, as he was part of this scam by association.

Thanks Bemused. I think now that his mom probably went and got the birth registered as occuring out of a hospital on August 4th (and they registered it on the 5th). It may actually have occured in Kenya in February , for God’s sake! I’ve also settled on the idea that Obama senior was not the real father. He was just enlisted for that job as he was the most likely guy to fill the job at the time (a rare black in Hawaii and a fellow student with Ann).
I’ve come to believe in the recent theory that Malcolm X amazingly enough was the real father. Only that incredible fact can rationallyand realistically explain the many many interested parties willing to invest so much time effort and money over many many years in the furtherance of Barrack’s education and career.
Another point: he could not have stayed in Bali wprking on his first book (unsuccessfully!) for as long as he did without having been an Indonesian citizen. Tourists are only permitted to stay a few weeks.
Looking at the above linked article on his Hawaiian homes, I’ll guess the little cottage in the back yard of the large house (at his birth certificate listed address) was the actual first dwellling of the grandparents (and their daughter). After living there for their first 3 or 4 years in Hawaii, they moved into an apartment. The article notes innocently that the elder Barack Obama is listed as living somewhere else. As is Ann Obama some time later!!
if he was born in Hawaii or registered thereafter he has a vault version of his birth certificate that states he a citizen, but it’s invalid and outdated. I am sure no one took it away when Lolo adopted him. His grandparents probably just started using it again when he returned to the U.S. I think he has gone through life using a defunct version rather than using a newer amended version reflecting the adoption that is the legitimate version on file in Hawaii. That’s why there’s no name change records found for him. He just went back to being Obama as it is on the original bc.
Why would anyone question it? I am sure it was plenty enough to get a US passport.
Looking at my last post, I now wonder if the famous meeting with BHO Sr. in Hawaii had anything to do with getting a Kenyan passport.

I never had to show my birth certificate at the U.S. embassy to get one. I was born in Europe and all they looked at was my naturalization papers. I know thats a different situation but:

I was in contact with Mr. Gary Kreep before the election to ask him if he could start a lawsuit against Obama before the election and he said he could not do so, because it would appear partisan and he could lose his non-profit status.
I called and emailed Gary Kreep last week and he was getting ready to file the lawsuit with Mr. Keys as the plaintiff to ensure the lawsuit met the standing requirement.
Note another way to get standing would be to add soldiers currently serving in the military or a family member such as a spouse. They can sue under the Federal Statute 42 U.S.C. Federal Statute 1983. http://www.usjf.net
This lawsuit was filed in California simply because that’s where Mr. Kreep is licensed under the United States and that’s where his non-profit United States Justice Foundation has been located since 1979.

We really need duplicate lawsuits filed especially in the high electoral value democrat won states. I plan on contacting Mr. Keys to see if he can get attorney to aid him in filing additional lawsuits in these needed states.

I had a thought after reading other blogs on this site.
Someone posted factcheck.org where obama says he is a UK citizen.
Reading further into it and the Keyan citizenship after the UK released it as a territory it shows 1963 as the new year for citizenship. I wonder if O refuses to show his BC and credentials because maybe he was born in 1963 the yr of the new keyan law and probably that his bc shows citizenship to UK. Just another thought.
And someone else brought up something about his bc that is shown on his website. It shows the father as African, and mother as caucasin. In the 60’s the term white and black were used not what is printed on his bc.
My kids were born in the 60s and 70s and it clearly states white. So yep, that is a fake bc.

Martins lawsuit in Hawaii – shot down. Who is going to make this terrorist fraud show his true identity?
I suppose that WE as citizens of the USA and under OUR CONSTITUTION do not have standing. This means that we are a “lawless land” country and states. We have NO law to make us do anything and our SPJustices and the state judges have just proven this over and over.
What next–stand here and take the abuse and terror that is about to RULE over us? If the laws of our land are against the citizens–then who does the constitution protect? Simple questions–please–no rocket science here.
