I have just received word that a lawsuit will be filed today in Federal Court challenging Barack Obama’s qualifications to be President.
I am told that ALL MEDIA should report to the U.S. District Courthouse in Philadelphia in approximately one hour.

If a suit is filed, don’t they (the Obama folks) have to provide solid evidence that it is indeed frivolous before they can dismiss a suit? It can’t be just he-said she-said. Obama can’t just say it’s frivolous and walk away from it.

I will keep praying that who ever is delivering this lawsuit has all their i’s and t’s covered, plus his/her Attorney by their side.
I have to believe that it isn’t just a minor detail, but something substantial, otherwise it could possibly be thrown out by the next day.
There is so much that Obama has done and so much we don’t know about him. We need to know all his records, associations and what they entail, original COLB and BC, fraudulent reports to FEC, an endless list that the media has just skimmed over and never reported.

Whatever it is, it’s unlikely that it can be dismissed as frivolous. I believe your courts have defined a “frivolous” suit as one “having no arguable basis in either fact or law..”
We have seen here and elsewhere that there is ample scope for argument in both fact and law….

The challenge needs to be made at the Democratic Convention. I doubt any federal judge could do anything before the convention, since the Constitution doesn’t prohibit somebody from being nominated if they are not eligible. Does “not eligible to the office of President” in article 2 mean not eligible to run for office or not eligible to take the oath of office? My guess is the latter.

Ok the suit is predicated on his loss of citizenship when his mother took him to live in Indonesia after marrying a foreign national and living in that country with her son for over four years according to the laws on the books at the time.
Even the remedy passed later by INS laws state he had to take an oath of allegiance when he turned 18 to become a “naturalized citizen”, not a natural citizen again. He’s had divided loyalties and can not be a natural born citizen again. This is the federal statutes. He didn’t even do that to regain his citizenship. As soon as we get the court stamped copy we will make it available to everyone. Please help us get the word out. This is not out of some obscure website.
The laws Phil cites are federal regulations handling loss of citizenshp by a minor child who follows his custodial parent’s citizenship. Thank you for any help you can give us to spread it. The media may not pick it up and report it.

You want to nominate someone who can run for the office but can’t serve? What will that do for party credibility? And so what if he is elected–you want to take credit for electing an ineligible candidate that can’t serve??????? a little non-sensical here I would say.
It is up to the dems and OBama to respond. The court will need to see his documentation. If he has nothing to hide, then show his COLB, citizenship papers, everything and prove himself.
The Court will not “take his word for it”. Neither should any American. It is Soetoro’s own fault for being “so above it all” that he couldn’t see.
The SCOTUS has ruled on similar cases and children don’t lose their U.S. citizenship. The best bet IMO, other than proving that Obama is committing fraud with a forged COLB, is to make sure people know Barry Soetoro was a dual citizen at birth with Great Britain.

It is interesting regarding timing. The Republican website that just came up also, the one about the Obama/Rezeko connection. Things like this are coming up fast. I thought the GOP would wait till after the democratic convention before they started in but then I got to thinking that maybe now they are feeling that not only will they sink Obama but they will sink the entire democratic party. If I was a republican I would want to do a massive clean sweep of as much of the democratic party as I could. Take the House, take the Senate, take the White House. Why settle for less when you can do a massive slam? When the crap hits the fan about Obama, a lot more than just Obama is gonna feel the heat. It’s going to be widespread across the democratic party.

Be careful what you wish for. If this goes to a friendly judge (friendly to the DNC) and it gets dismissed as frivolous or with no merit, no other court will pick it up, even if it is true. This would play right into the hands of the Obama campaign and the MSM would dismiss any similar claims.
So what is known about the lawyer filing? Is he an Obama surrogate, can he be connected to the GOP? These are all relevant questions.

The Qualifications of being president of the USA is of that they need to be born in the USA or the terroritory of the USA. So far Obama was born in Hawaii by his american mother. That makes him as a American Citizen. The birth cerd. would be enough proof he is an American citizen.

McCain was born on a American US base not a territory or a state a base.

Joe–sadly, you’re mistaken. A child born to military parents assigned overseas is deemed to have “dual citizenship”. Since you don’t know THAT, I’ll explain that dual citizenship means he/she can claim either the U.S. or the nation where he/she is born as their home country. My son can choose to be a Japanese citizen if he desires. You might want to look into something called a SOFA (Status of Forces Agreement) before making embarassing comments.
